Bio Profile:
Preeti graduated from King's College, London and was called to the Bar in Mauritius in 1995.  She was for several years  the Head of Legal for Barclays Bank (Mauritius) and Senior Counsel for Barclays’ regional team.

Preeti  is currently the Managing Partner of Ffooks Gokulsing LLP, in partnership with John W Ffooks & Co, the only international law firm in Francophone Africa offering combined Napoleonic and English law expertise with focus on transactions in French speaking, sub-Saharan Africa. She advises on a variety of international banking and finance transactions across Africa  and South-East Asia as well as on a wide range of commercial issues.

Preeti also conducts a number of in-house training programs on specialized legal issues such as legal risk management and  corporate governance, amongst others.

Course description:

The course is targeted to professional law practitioners envisaging in house positions and generally to lawyers dealing with in house lawyers in their practice. It provides an introduction to the practicalities of the working life of an in-house lawyer, points towards some relevant rules and legislation, and provides some practical tips to keep lawyers right.

Bio profile Mr Mrinal Jain

Mr Mrinal leads Secretariat International’s Economic Damages and Valuation Practice in India with the focus on quantification of damages, claims and losses involving complex economic, financial and valuation issues in domestic and international arbitration matters including investment treaty arbitration cases. He  is recognized as one of the leading expert witnesses in international arbitration by Who’s Who Legal’ s Arbitration 2019, 2020 and 2021 Lists and Thought Leader Arbitration Expert Witness 2021 (https://whoswholegal.com/mrinal-jain). He is a Member of SIAC - Users Council and appointed on the Board of Society of Construction Law – India, the Advisory Board of C.O.R.D (Centre for Online Resolution of Disputes) and the Advisory Board of Centre for Arbitration and Research, Maharashtra National Law University in India. He is also appointed on the Global Advisory Board of ENERAP (Energy Related Arbitration Practitioners).  He commenced his professional career with Ernst & Young in New York in 2007 and brings with him about 15 years of relevant experience. He was awarded with All India Economics Merit Certificate in 2001 post which he graduated in Economics Honors from St. Stephen’s College (Delhi) in 2004 and pursued his major in Finance from Fordham University in New York in 2007.

Anne-Sophie is a barrister with 18 years’ experience working in contractual disputes in litigation and arbitration, both domestic and cross border.  As such, she has worked with various damages experts in disputes involving company and  shareholders disputes, real estate developments, construction projects, derivatives as well as investment treaty claims.

Course description:

The session will cover the following topics:

  1. Role of an expert witness in dispute resolution
  2. Basic legal principles applicable to contractual damages claims in Mauritius / French and English law
  3. Damages claims in contractual arbitration claim and claims arising out of investment treaty
  4. Types of damages: Reliance loss  V Expectation loss
  5. Methodologies for assessing damages including the Discounted Cash Flow method
  6. Pre-award interest
  7. Date of assessment of damages
  8. Case Studies

Resource Person: Andrea Lapunzina Veronelli  (Legal Counsel and PCA Representative in Mauritius)

Bio profile:

Andrea Lapunzina Veronelli is Legal Counsel and Representative of the Permanent Court of Arbitration (PCA) in Mauritius, assisting with the implementation of the Mauritius International Arbitration Act and with the promotion of Mauritius as a venue for international arbitration and PCA services throughout the African region.

As Legal Counsel, Andrea acts as registrar and administrative secretary in arbitration and other forms of dispute resolution proceedings. She also assists the PCA Secretary-General with appointing authority matters, including challenges, under the UNCITRAL Arbitration Rules and other procedural rules.

Prior to joining the PCA, Andrea worked as a practicing lawyer for nearly five years at an international law firm in Paris, France, participating in the representation of States and companies in arbitration procedures under the aegis of the ICC, PCA and ICSID, as well as in domestic French law procedures related to arbitral awards and international private law matters.

Andrea is a graduate of Université Paris-I Panthéon Sorbonne and Université de Versailles Saint-Quentin-en-Yvelines, where she obtained a Master 2 degree in international arbitration. She qualified in 2017 to practice at the Paris bar (omitted as of 12 August 2019).

Synopsis

“Conflict/Dispute is a fact of life but it is something that one should resolve as quickly as possible. If dispute/conflict is properly managed, it would benefit all the parties. Mediation is one of several approaches to resolving conflicts/disputes. It differs from adversarial resolution processes by virtue of its simplicity, informality, flexibility, and economy.

The Principles of mediation include non-adversarialism, responsiveness, self-determination and party autonomy. Thus, mediation provides the opportunity for parties to agree terms and resolve issues by themselves, without Court hearings and with or without the need for legal representation.
