Course Description:

The Competition Act 2007 (the ‘Act’) provides for the control of merger situations by the Competition Commission. Merger situation is broadly defined under the Act and captures various forms of acquisitions of control. Where a merger situation substantially lessens competition in any market in Mauritius, the Commission is empowered to impose appropriate directions including blocking the merger and requiring divestment of assets.

This session will explain the major provisions of the Act with respect to merger control, the assessment process, why enterprises are encouraged to seek the guidance of the Competition Commission and how enterprises may seek the guidance of the Commission with respect to merger situations.
